US Judge Orders Release of Abrego Garcia from Immigration Detention
A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without lawful basis.
"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge stated in her ruling.
The case originates in a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to answer human smuggling allegations, he was detained in immigration detention.
In her decision, the judge pointed out that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
